Peddler Ordinance Passed By Council

The city council last night passed the peddlers ordinance that has been under study and discussion for several weeks.
It also directed City Manager E. F. Lee to conduct a survey and estimate - before the next council meeting if possible – how many revenue bonds would have to be sold to provide adequate extensions for Dalhart’s sewer system.
It also discussed a proposed street paving program – with public participation in the cost as was done in Dalhart several years ago. A decision on it is expected soon.
A council spokesman said that Chamber of Commerce directors and the C of C Merchants Activities committee had studied and approved the peddler's ordinance and requested its passage.
It provides, he added, that all transient or itinerant persons selling, soliciting or taking orders for any goods must register with the city clerk and – if not dealing in interstate commerce – must purchase an annual city peddler’s license and provide a bond.
Even though in interstate commerce, a peddler must register with the city clerk, leaving name, home address name and address of the company he or she is representing, and the name of the products or products being sold so that check-ups can be made if deemed advisable.
The term, interstate commerce, as applied to such an ordinance, the council spokesman said, means that the peddler is selling something that is to be delivered later of outside the state.
The ordinance, in conformity with state law, the spokesman added, exempts growers and producers of farm or dairy products. It also, he said, exempts persons living in the community, even though they sell from door to door.
The ordinance provides that if suit or other legal action is ever brought against any peddler under this ordinance that it shall be heard in either Dallam or Hartley Counties.
